Okay, now I understand, Thanks. You said sometimes you have to walk away to come back and battle another day. I have heard another saying like that, too. "those that learn to run away, live to fight another day." I am a novice at fighting the government, or the volunteers they employ. I will have to learn on my own the futility of it. I believe the Swan is worth the aggrivation. I just hope I will have the wisdom to know when it is time to walk away or run away. So far this enlightenment has not hit me over the head, and that is what it will have to do, before I will give up. In the long run, if my government or their volunteers they employ, gets away with stealing from me this blatantly, it will no longer be "my" government. The taking of our roads, and the closing off of our public land, to all but the young, the healthy, and the Sierra Club, is an abomination to our spirits. The "taking" of private property for the publics benefit, without due process, or just compensation is an assault on our constitutional rights. I own those rights and I will not give them up without a fight. It is just that simple for me! The volunteers see what they did as fun and games, but I see it as a statuatory taking of my property. A complete taking of my private home, and valid mining claims, without due process. The great Lynne Gun, describes a taking quite well himself. Roger Pilon of the Cato Institute in an article in the Cato Handbook for Congress (Cato. org) describes a complete taking, as the loss of ownership rights, not just the loss of a private home and land. He said the laws of property rights after acquisition and disposal, consist of the right of sole dominion,- or the right to exclude others, the right against trespass, the right of quiet enjoyment and the right of active use. I owned clear and free title to my home and buildings and clear and free title to these rights, also. My mining claims, the Silver Swans had never before reverted back to the government since 1930 and their title had never before been clouded, and they enjoyed certain existing grandfathered rights. Under the 1872 mining laws. this meant they were elligible for patent, surveyed, and I could apply for the clear deed to the land. Now because of its taking for public recreation, it is no longer eligible for patent, so I will never be able to apply for the clear deed to my land. Even if they were returned to me today, according to the patent regulations, this would no longer be possible. And the volunteers call it all fun and games. They have renamed the claims, the White Swan, and changed their serial numbers, while they were just out having fun and bragging about what big shots they are. If claim jumping makes them big shots, than I have to agree, with them, they are our countrys finest!
